These Terms & Conditions ("Terms") govern the use of Coliving Insights ("Platform"), provided by Coliving Insights ("we," "our," or "us"). By accessing or using any of the services offered by the Platform, including but not limited to the Events, Jobs, Marketplace, Showroom, Articles, News, Knowledge Hub, Global Directory, and Coliving Insights Talks / Webinars modules, you ("User" or "Member") agree to comply with and be bound by these Terms.

1. General Overview

Coliving Insights 2.0 is a platform designed to provide industry insights, connections, and resources related to the coliving sector. The platform includes various modules, such as Events, Job Listings, Marketplace, Showroom, Articles, and News, each with specific terms of use. These modules are intended for professional and educational purposes, connecting users within the coliving and shared living industries.

2. Eligibility

To use the Platform, you must be at least 18 years old and have the legal capacity to enter into agreements. If you are accessing the Platform on behalf of a company or organisation, you represent and warrant that you are authorised to bind that company or organisation to these Terms.

3. Account Registration & Security

To access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to maintain the security of your account. You are responsible for all activity under your account and agree to immediately notify Coliving Insights of any unauthorised access or security breaches.

4. Exclusion of Liability

• Platform Availability: While Coliving Insights makes reasonable efforts to ensure the quality, accuracy, and availability of the Platform, we cannot guarantee uninterrupted access or error-free performance.
• Service Interruptions: You acknowledge that there may be occasional downtimes, maintenance, or other disruptions in service. Coliving Insights is not liable for any damages or losses caused by such interruptions.
• Third-Party Services: Coliving Insights does not assume responsibility for third-party content, services, or links provided through the Platform. Any interactions with third parties, including purchases, are solely between you and the third party.‍
• Viruses & Malware: Coliving Insights is not liable for any damages caused by viruses, malware, or other harmful software. You are responsible for maintaining appropriate security measures on your devices.

5. Subscription & Membership

Some features of the Platform, including access to full articles, Coliving Insights Talks, and other premium content, may require a paid membership or subscription. By subscribing, you agree to the subscription terms, including recurring payments (if applicable), and will be bound by those terms.

6. Use of the Platform

You agree to use the Platform in a lawful manner and to comply with all applicable laws and regulations. You agree not to engage in any activity that interferes with or disrupts the Platform, including:

• Using the Platform for illegal or harmful purposes.
• Attempting to reverse engineer, hack, or otherwise compromise the security of the Platform.
• Engaging in fraudulent, misleading, or deceptive conduct.

7. Intellectual Property

All content provided on the Platform, including but not limited to text, images, logos, graphics, designs, and software ("Materials"), is owned by Coliving Insights or licensed to us by third parties. You may not reproduce, modify, distribute, display, or otherwise use the Materials for any public or commercial purpose without our prior written consent.You acknowledge that Coliving Insights retains all rights to the Platform, and you grant us a license to use your content (if applicable) for the purposes of displaying or facilitating your use of the Platform’s modules, subject to these Terms.

8. Specific Terms for Each Module

8.1 Events

• Event Posting Responsibility: Members have the ability to post events related to the coliving industry. By posting an event, the member takes full responsibility for organising, promoting, and managing the event, including attendee registration and compliance with relevant laws.‍
• No Liability: Coliving Insights is not responsible for any issues related to event execution, cancellations, or attendee management. The event organiser is solely responsible for ensuring the accuracy and legality of all event details.

8.2 Coliving Insights Talks / Webinars

• Exclusive Member Access: Coliving Insights Talks and Webinars are primarily available to members of Coliving Insights. Non-members may, at certain times, be offered the option to purchase one-off access to individual webinars. The availability of such access will be determined on a case-by-case basis.
• Content and Access: These events offer valuable industry insights and thought leadership on relevant topics. Members can access past webinars through the member portal, subject to the technical capabilities of the platform. The availability of webinars for re-watch will depend on these technical possibilities, and Coliving Insights cannot currently guarantee access to all past events.‍
• Event Conduct: All participants, whether members or non-members, agree to behave professionally and respectfully during webinars and not to disrupt the sessions.

8.3 Marketplace

• Directory of Services and Products: The Marketplace functions as a directory for products and services related to the coliving industry. Members can list products or services they offer but are solely responsible for the quality, accuracy, and legality of their listings.‍
• No Transactional Services: Coliving Insights does not facilitate transactions between buyers and sellers. All interactions and transactions are at the user's own risk.

8.4 Showroom

• Projects Directory: The Showroom provides a directory of coliving projects, sites, and new buildings relevant to the coliving sector. Members can showcase their projects but are responsible for ensuring the accuracy and truthfulness of the information they provide.
• Platform Verification: While Coliving Insights works to curate and ensure the accuracy of project listings, the responsibility for the correctness of project details lies with the member.

8.5 Articles

• Article Submission: Members may submit articles to the Articles module. We reserve the right to determine whether an article is relevant, insightful, and aligned with the platform's objectives. Articles should contribute to the collective knowledge and thought leadership of the coliving industry.
• Promotion Limitations: Articles must not serve as direct promotion or advertisement for businesses. We encourage articles that highlight the author's expertise and insights while contributing meaningfully to the conversation.
• Access to Full Articles: Full access to articles is available only to members. Non-members may view summaries or excerpts of articles.

8.6 News

• News Posting and Access: The News module provides industry-related news. While news content is available for all users, only Coliving Insights members can post news stories. Non-members can contribute a one-off news item through the advertisement media kit.
• Member Contribution: All news must be factual, relevant, and contribute positively to the industry. Coliving Insights reserves the right to remove posts that do not meet these standards.

8.7 Jobs

• Job Posting Responsibility: Members can post job openings related to the coliving industry. By posting a job, the member takes full responsibility for the accuracy of the job details, including the position, job requirements, and qualifications.
• No Liability: Coliving Insights is not responsible for any issues related to job postings, candidate hiring, or employment disputes. Members posting jobs are solely responsible for compliance with relevant employment laws and regulations.‍
• Job Application Process: Coliving Insights does not facilitate the application or hiring process. All job applications and interactions are at the user’s own risk.

9. Fees & Payment

Certain features of the Platform may require payment, including membership subscriptions, (online) event registration fees, and additional listings or postings (such as Job postings, Product listings, or Event promotions). You agree to pay all applicable fees, which may include taxes. Payments are non-refundable unless specified otherwise in the event or subscription terms.

10. Termination of Access

Coliving Insights reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, if you violate these Terms or engage in behaviour that disrupts the Platform or its users. In the event of a violation, Coliving Insights may, at its discretion, provide notice and allow you a reasonable opportunity to address the issue before access is terminated. Upon termination, you must immediately cease using the Platform and any content provided. Payments made prior to termination will not be refunded unless specified otherwise in the Terms.

11. Disclaimers & Limitation of Liability

The Platform is provided "as is" without any warranty, express or implied, including but not limited to the accuracy, reliability, or completeness of the content. Coliving Insights does not guarantee that the Platform will be free from errors or interruptions.To the fullest extent permitted by law, Coliving Insights is not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Platform.

12. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect, use, and protect your personal data. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

13. Governing Law

These Terms are governed by the laws of The Netherlands, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the appropriate courts in The Netherlands.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to the Platform or legal requirements. We will notify users of significant changes, and the updated Terms will be effective immediately upon posting on the Platform.
